The Efficiency Council Board of Directors to ensure conformance with the Council’s membership criteria. If there is any uncertainty as to whether a business or organization would be classified as a Full or Associate Member, the final determination rests with the Board of Directors.
Are Efficiency Council Membership Dues Tax-Deductible? The California Energy Efficiency Industry Council is a nonprofit, tax-exempt 501(c)(6) organization. Membership dues paid to the association are not deductible as charitable contributions, but they may be deductible as a business expenses. However, any portion of your dues that supports Efficiency Council activities that fall under the formal definitions of “lobbying” are not deductible business expenses. Lobbying is defined by law for federal income tax purposes to be “an attempt to influence legislation.” This encompasses some of the activities of the Efficiency Council in bringing the voice of California energy efficiency businesses to the various public policy discussions that affect its members. Thus, the Efficiency Council estimates that 23% of membership dues are not deductible in 2012 (9% in 2011 and 2% in 2010) because of the portion of its activities that are formally defined as lobbying on behalf of its members. The Efficiency Council will notify members each year of the updated portion of membership dues used for lobbying.
